WALTON COUNTY, Fla. (WJHG/WECP) - A Mossy Head man is in custody following a shooting on Walters Road on Friday.

Toby Burkett, 60, of Mossy Head was arrested early Saturday morning, according to the Walton County Sheriff’s Office.

Burkett is charged with aggravated assault with a deadly weapon without the intent to kill, three counts of possession of a gun by a convicted felon, shooting into an occupied vehicle, criminal mischief, obstruction and using a firearm during a felony.

Deputies responded to the Mossy Head area late Friday night after a report of shots fired. There, they learned that Burkett had reportedly fired a gun into a vehicle with the victim at the wheel.

The incident allegedly began when the victim revved the engine of his car while in the roadway in front of Burkett’s home. The victim said he and Burkett then got into a verbal argument which quickly escalated, ending with Burkett shooting in the direction of the vehicle.

Deputies found one bullet hole in the driver’s side door on the vehicle. The victim was uninjured, as the bullet did not penetrate all the way through the door.

Burkett resisted arrest, and deputies used a taser to get him into custody. He was taken to a local hospital for evaluation and reportedly refused to speak with investigators.

The Walton County Sheriff’s Office received a search warrant for Burkett’s residence and truck, where deputies located a revolver-style .22 caliber handgun with two spent casings inside. They also found one .308 caliber rifle cartridge in the vehicle.

Authorities said the investigation is ongoing while Burkett remains in custody.
